IHC halts proceedings against Imran in case filed by Dar’s son

ISLAMABAD: The Islamabad High Court (IHC) on Monday issued stay order in a defamation case filed by Ali Mustafa Dar, son of former finance minister Ishaq Dar, against PTI chairman Imran Khan and stopped sessions judge to proceed further in the case.

A single-judge bench of IHC presided over by Justice Mian Gul Hassan Aurangzeb took up the case for hearing Monday. Advocate Babar Awan appeared in the court on behalf of Imran Khan.

Babar Awan took the plea that all the members of Dar family were absconding and instead of appearing before the court, all the members were in London.

The Accountability Court has declared Ishaq Dar absconder and his wife and children have not appeared before the court yet.

During the course of the hearing, the learned judge inquired whether NAB has summoned children of Ishaq Dar.

Counsel for Imran Khan said, “Yes, NAB has summoned them several times. HDS tower is Dubai property. Due to non-appearance in the court by Ishaq Dar, the Supreme Court has suspended his membership of Senate.”

Babar Awan pleaded that how a sessions court can run defamation case filed by the person who is an absconder and who does not respect courts.

“The principles of Supreme Court in Ishaq Dar’s case are very clear. The same principles apply to IHC,” he argued.

The court after hearing the arguments ordered the issuance of stay order besides halting the sessions judge from initiating further proceedings. The court also adjourned the hearing of the case.
