Conflicting rulings concern Drug Regulatory Authority of Pakistan

ISLAMABAD: “Conflicting” judgements by various high courts regarding medicine prices and interim injunctive orders by manufacturers and importers have become a cause of concern for the Drug Regulatory Authority of Pakistan (DRAP).

DRAP’s report in a suo motu case pertaining to prices of medicines states that civil suits related to the matter are not permissible under Section 39 of the Drug Act 1976 and the same section says that civil courts do not enjoy jurisdiction in the matter.

The report also says that matters pertaining to import, quality control, export, fixing of prices, registration and licensing falls under the purview of the DRAP.

DRAP has also claimed in its report that only the Islamabad High Court (IHC) has jurisdiction in the matter.
