SC dismisses review petition against Section 202 of Election Act

LAHORE: The Supreme Court on Monday dismissed a review petition challenging certain conditions imposed on political parties under Section 202 of the Election Act 2017.

The three-member bench, headed by Chief Justice Mian Saqib Nisar, heard the petition filed by Pakistan Millat Party Secretary General Sheikh Mushtaq Ali, at Supreme Court Lahore Registry.

Earlier, the petitioner’s counsel arguing before the bench submitted that under Section 202 of Election Act, every political party must provide a list of at least 2,000 members with their signatures or thumb impressions along with copies of their national identity cards and proof of deposit of Rs 200,000 in favour of the Election Commission of Pakistan as the enlistment fee.

He said that the conditions imposed for political parties enlistment were not only against basic human rights but also Article 17 of the Constitution. He pleaded with the court to set aside the conditions.

However, the bench, after hearing arguments, dismissed the review petition.
