Appointment of IHC judge challenged in SC

ISLAMABAD: A petition was filed on Wednesday in Supreme Court, challenging the appointment of an Islamabad High Court (IHC) judge.

The constitutional petitions reasoned that the appointment violated the requirement of equal representation in IHC from all regions.

The petitioner Ali Azim Afridi highlighted the Article 1 of the Constitution that demands due representation in the IHC of the people from the tribal areas, hoping that the top court would set aside Justice Miangul Hassan Aurangzeb’s appointment under Article 1 184(3).

According to the petitioner, Advocate Athar Minallah from Khyber Pakhtunkhwa had also been nominated for the vacancy. The appointment deprives the territory of “having a qualified person to be appointed” as the judge of IHC, he asserted.

The petition included that Justice Miangul Hassan Aurangzeb and secretaries of Judicial Commission of Pakistan, parliamentary committee, President Mamnoon Hussain, Prime Minister Shahid Khaqan Abbasi, Khyber Pakhtunkhwa Bar Council, Federation of Pakistan and Supreme Judicial Council as respondents.
