Widow moves SHC to acquire inherited property from brothers-in-law

KARACHI: A widow on Saturday filed a constitutional petition in the Sindh High Court (SHC) against her brothers-in-law for allegedly depriving her of the property inherited to her and her child offer her husband’s death.

The petitioner, through her counsel Nadeem Shaikh, submitted that her husband Muhammad Mateen died of cancer in February 2010. She said that her husband left behind a flat in Saddar Karachi, five shops in Bismillah Electronic Market and a shop in Islamabad’s Jinnah Super Market. All these properties were rented out, she said.

She submitted in her petition that during the period of her husband illness, her brothers-in-law, Shoaib and Habib, were collecting rental amount from the tenants as her children were minor.

The petitioner added that after some time, her brothers-in-laws had stopped making payment of rent and did not hand over her the property documents.

She said that she and her children are living in poor condition and they still reside in a rented flat as her brothers-in-law have deprived her and her children from their fundamental rights.

She informed the court that Shoaib and Habib had filed a suit in 2015 with malafide intention and to usurp her and children’s legal and lawful rights. She said that she had approached the Rangers and police for redressal of her grievances but to no avail.

The petitioner submitted that her brothers-in-law threatened her of dire consequences when they came to know that she was going to move a petition in the SHC.

Making the chief secretary and the Station House Officer of the concerned police station as the respondents, the petitioner requested the court to direct the authorities concerned to enquire into the matter and submit report before it within stipulated time limit so that her orphan children be provided justice.
