ISLAMABAD: The Supreme Court (SC) dismissed the appeal plea filed against the acquittal of accused persons in a murder case because of the delay in filing the appeal.
A three-member bench of the SC presided over by Justice Asif Saeed Khosa took up the case for hearing on Friday.
Muhammad Javed, the father of the victim, appeared in the court and said, “I am a poor man. I filed the appeal in time but the registrar asked me to bring papers due to which the matter was delayed by four days.”
Justice Asif Saeed Khosa said, “The entire country is poor except for a few persons. The law has set time for filing of an appeal. As per the law we cannot hear a time barred petition.”
“Please be compassionate to me,” the petitioner said, “it was only delayed for four days.”
Justice Asif Saeed Khosa said, “It is a matter of law rather than a matter of mercy. If we hear a time barred petition then it will become a precedent. Had there been a lawyer here, you would have not faced difficulties.”
