PESHAWAR: The Peshawar High Court (PHC) on Friday ruled that Senate elections will not take place in the Khyber Pakhtunkhwa (KP) Assembly until Member of Provincial Assembly (MPA) Baldev Kumar takes oath.
Justice Ikram Ullah Khan of PHC ordered, “There will be no Senate elections in KP until Kumar has taken his oath and court orders upheld.”
“We have not just directed you to produce him but to also take his oath as a member of the KP assembly,” he added.
Kumar’s counsel Muhib Jan Salarzai argued before the court that his client was not allowed to enter the assembly and his oath is still pending despite court’s orders, adding that the Senate elections will be held on March 3.
The KP Assembly speaker earlier on Friday adjourned the session for an indefinite period over lack of quorum after opposition and the treasury members staged a walkout in protest against the presence of Kumar in the house.
Pakistan Tehreek-e-Insaf (PTI) lawmaker Mehmood Khan warned they will not allow Kumar to take the oath.
On Tuesday, angry members of KP Assembly had broken the quorum of the house to block the administering of oath to MPA-elect on minority seat Kumar, an accused in the murder of former KP Assembly lawmaker Sardar Suran Singh.
The MPA-elect is behind bars for the alleged murder of former advisor to chief minister Sardar Soran Singh near his house in district Buner. The accused was on the second spot on the priority list of the ruling PTI for the minority reserved seats.
Baldev Kumar was produced for administering the oath as a member of KP assembly on the orders of PHC. He was sitting in the house and remained waiting for the announcement of the speaker to invite him for administering the oath.
