KP passes marriage functions law; dowry demands by grooms’ family banned: report

PESHAWAR: The Khyber Pakhtunkhwa(KP) Assembly has passed a law making it illegal for the grooms’ family to demand dowry from the brides’ family. The offence is punishable by a fine of up to Rs 300,000 and a minimum of two months in prison, or both. The law is intended to clamp down on the custom of paying dowry.

The law applies not just to the grooms’ family but also anyone demanding dowry at their behest whether in cash or as other items. However, legal action can only be taken against a male member of the grooms’ family.

Khyber Pakhtunkhwa Marriage Functions (Prohibition of Ostentatious Displays and Wasteful Expenses) Bill 2018, passed with a majority vote after it was introduced by Jamaat-e-Islami (JI) lawmaker Rashida Riffat.

The bill also includes other injunctions including a ban on decorating the locality where the ceremony is taking place, especially lighting; use of firecrackers, loudspeakers, and ensuring that the event concludes before 11pm. The total value of gifts given to the bride by her parents or other family members must not exceed Rs 100,000 as well.

The hosts for smaller events like Nikkah or Mehndi are not allowed to serve anything except beverages for their guests. The menu served at weddings is also limited to one dish of rice, gravy, bread, salad and dessert each.

Violations of the aforementioned injunctions can entail imprisonment not exceeding three months or a fine of up to Rs 200,000, or both.  In addition, the bride will be the sole owner of the property gifted by the husband and a violation of this clause can lead to a penalty of Rs200,000 and a three-month imprisonment.

Anyone witnessing a violation of the law at a wedding ceremony can file a complaint with First Class Magistrates in writing.
