Show-cause notice issued to LHC judge dismissed by SJC

LAHORE: The show-cause notice issued to Lahore High Court (LHC) judge Justice Mazahir Ali Akbar Naqvi over alleged misconduct was dismissed by the Supreme Judicial Council (SJC) on Wednesday.

Chief Justice Mian Saqib Nisar chaired the hearing while Makhdoom Ali Khan represented Justice Naqvi. The prosecution was represented by Attorney General Ashtar Ausaf.

Following the conclusion of arguments, the show-cause notice issued in 2016 was dismissed by SJC. The judgment that led to the proceedings was authored by Justice Asif Saeed Khosa.

Sub-para (1) of para 9 of the SJC’s Procedure of Enquiry 2005 was the basis for the notice.

In 2013, LHC’s granted bail to an accused named Nazir Ahmad. The decision was, however, dismissed by the higher court.

“Discretion exercised by the learned judge while passing the impugned order in the instant case has appeared to us to be somewhat colourable,” the court’s order stated, “After dismissal of second application for suspension of sentence bearing the same ground the only difference in the respondent’s third application for the same relief was a different learned counsel for that respondent.”

Following that, proceedings against the LHC were started by SJC. A show-cause notice was thus issued to the LHC judge who challenged the notice before withdrawing his petition.
