CDA ordered to vacate land from illegal possession of former federal minister

ISLAMABAD: Prime Minister’s office has ordered the Capital Development Authority (CDA) to get 30-Kanal precious land vacate from the alleged illegal possession of former federal minister for environment Hameedullah Afridi.

Taking action over the application of a resident named Muhammad Hanif of the federal capital, PM office has advised CDA to get the land vacated from the possession of former federal minister immediately and submit a report in this regard. However, some influential officials of the CDA are creating hurdles.

They are reluctant to take firm action against the said minister and are using delaying tactics to get the land vacated from the possession of former federal minister.

Documents available with Pakistan Today disclosed that Hamidullah Afridi had obtained the land from CDA in the posh area of federal capital free of cost during 2009 in the name of beautification. CDA handed over the land to Afridi for establishing a garden under certain term and conditions.

According to said terms and conditions, the land will be kept open for common public. Neither barriers nor boundary wall will be established. Similarly, CDA is authorised to vacate the land at any time on finding any violations, but courts will not be approached for it.

The land is adjacent to the residence of the minister located in sector F-10/4, Street No 56, House No. 294 in Islamabad. The former federal minister had placed barriers and a wire-wall around the area. He also made some constructions over there allegedly in connivance with the officials of the CDA and kept the land closed for public in the name of security.

According to sources, CDA had earlier tried to vacate the area upon violation of terms and conditions but the minister instead of handing over the precious land to CDA approached the court. The minister approached the civil court, sessions court and Islamabad High Court to get an order against CDA’s action but failed.

CDA also could not get the land from the possession of the minister.

Documents further revealed that Muhammad Hanif, a resident of sector F-10/4 in Islamabad, had requested the PM to take action against the said possession of former federal minister. The resident raised problems being faced by the public.

The former minister, while talking to Pakistan Today said that the land is of CDA and he has been maintaining the garden at his own cost. He added that he placed wire-wall around the area for security purposes as he and his family face security threats.

The sources, however, maintained that CDA officials are using delaying tactics to get the land vacated and they are advising the minister to get a stay order from the court and keep the possession in hand.

CDA’s spokesman said that the authority has given two-day time to the former minister to remove his constructions and get the area cleared. He added that the CDA is taking strict action against all illegal possessions as per the orders of PM and Islamabad mayor.

He said that CDA has also launched a crackdown on illegal occupants of lands and buildings and vacated government’s property from illegal possessions.

It is pertinent to mention that though Justice Shaukat Aziz Siddiqi of Islamabad High Court had earlier passed historic orders to stop the wrong use of government land, officials of CDA, however, have been not taking strict action against the politicians as mere warnings were issued and no strict action was reported so far.

CDA has already assured the IHC that the land which is in the possession of Hameedullah Afridi will be vacated soon.

  1. Minister of State for Information Marriyum Aurangzeb is calling laws of lands are black, laws are in black & white but you politicians are black and ugly, should be no place on this land for these black and corrupt politicians. Shame on you.
