ISLAMABAD: The Supreme Court (SC) while disposing of a petition pertaining to the amendment in Muslim Family Laws observed that “legislation is a domain of parliament”.
The court further observed that there should be appropriate legislation for every sect regarding dowry, inheritance and divorce.
A two-member bench of the apex court presided over by Justice Ijaz Afzal Khan on Thursday started hearing on the petition filed by Syed Iftikhar Hussain Naqvi. During the course of the hearing, Justice Ijazul Ahsan remarked, “How the SC can direct legislature for enacting laws, as the job of the apex court is only to interpret the law.”
Justice Ijaz Afzal Khan remarked, “Muslim family laws don’t apply to all sects while Federal Shariah court had given a judgment on section 4 when it was challenged. He further said that if a judgment could be given on section 4 then why section 7 could not be challenged.
Justice Ijaz Afzal remarked under section 20 Shia sect law will be applicable to them.
Justice Ijaz ul Ahsan observed, “In litigations, judgments are given keeping in view Shia sect laws”, as the Constitution gives protection to every sect in the country.
