Asad Umar submits bill in NA seeking amendment in CDA Ordinance

Pakistan Tehreek-e-Insaf (PTI) MNA Asad Umer submitted a bill in National Assembly seeking amendment in CDA Ordinance (XXIII1960) in order to stop the authority from acquiring land of the citizens of federal capital ‘illegally’.

The PTI MNA from Islamabad said that the people of capital territory cannot be deprived merely on the policy of Robin Hood ‘To rob the peter and pay the Paul’.

The ownership of the land is protected under the condition and this deprivation must come to an end, as the acquisition under the authority has badly maneuvered the private right, he added.

The purpose of this private bill, a copy of which is available with Pakistan Today, is  to seek  amendments in Capital Development Authority (CDA) ordinance section 2-Definition 2(k) Market value,  section 22, Section 25, chapter  4  (iv) and sections  26,27, 28, 29, 30, 31, 32, 33, 33A, 33B, 34,35,36A of the CDA  ordinance,1960.

It was demanded that the act may be called CDA ordinance (Amendment) ACT 2016.

The purpose of Capital Development Authority Ordinance (XX11 of 1960) 27th June 1960 was to acquire the land and establish capital of Islamic republic of Pakistan. The Master plan was carved out within the district Rawalpindi and vast land has been acquired to carry out the purpose.

All essential buildings, National Assembly, President House/Secretariat, Prime House/ Secretariat, Pak Secretariat, Supreme Court of Pakistan, Federal Shariat, Federal Service Tribunal, FBR House, Senate, MNA hostel, Parliament Lodges, State Bank of Pakistan , Mosques, Imambargahs, churches, parks, playgrounds, etc have been built, the bill stated.

He said that since the CDA had already built the new sectors; so there is no need of the ordinance at present and owners should be allowed to take decisions regarding their lands.

Asad Umar pleaded that sufficient acquisition has already been made from the affectees of Islamabad for public purpose and displacing them from their native areas is not justified, as no such authority has been provided in laws of LDA, KDA and FDA etc.

The public purpose is defined in the constitution of Islamic Republic of Pakistan and the acquisition is affected by depriving the people from their land and livelihood. The people of the state cannot be deprived for indefinite time and purpose and this practice must be put to end.

The PTI MNA stated that the right of ownership of the residents of Islamabad should be redeemed to the owners, adding that only this purpose necessitated the amendments in CDA Ordinance 1960.

Lashing out at the CDA, he alleged that the body became a white elephant and is occupying the land of innocent people with impunity.

He said that the land of dwellers is being forcibly acquired and the CDA is earning billions of rupees in the name of developing new sectors. He said that the CDA did not pay the due land value to the owners.
