IHC summons Deputy Sec. Establishment in passport office’s contract employees’ case

A writ pertaining to non regularising of Grade 16 and 17 contract employees of affiliated organizations of Federal Ministry of Interior, Passport and Immigration Directorate came up for hearing in the court of Mr. Justice Mohsin Akhtar Kiyani of Islamabad High Court.

The learned Justice directed the Deputy Secretary Establishment to appear personally on the next day of the hearing and explain why the affected employees were not being regularised. Barrister Aqeel Malik and Nabeel Rehman represent the affected employees.

While referencing the Supreme Court (SC’s) recent decision about the regularisation, the learned judge directed the Deputy Secretary Establishment to personally appear on the next hearing and inform the court as to the reason the relevant employees are not regularized.

The learned judge also ordered Federal Public Service Commission (FPSC) to stop any hiring for the particular department.

In fact, he said that even if the contract employees’ appointments were illegal, SC had recently passed an order declaring the appointing authority responsible for this lapse and not the candidates.

The lawyers representing the defendants argued that their hiring had done by the rulebook and relevant regulations; they are not responsible for any lapse in procedure. The learned judge has set the next date of hearing on December 15, 2016.
