The Islamabad High Court (IHC) Thursday turned down plea against sealing under construction multi-storey Grand Hyatt Hotel located at Constitution Avenue.

A single judge bench of Justice Mohsin Akhtar Kayani announced the judgment which was reserved earlier after completion of arguments by the litigants counsels in a plea moved by Grand Hyatt Hotel owners challenging the sealing of the building by Capital Development Authority (CDA).

Earlier, CDA counsel Kashif Ali Malik, submitted notification for the cancellation of the 99 years lease of the hotel awarded to the BNP (Private) Limited and informed the bench that the hotel management was violating CDA bylaws as property worth of billions of rupees including 260 flats of the building were sold out.

He said the civic body terminated the lease in accordance with the law as neither court barred in this regard nor CDA laws showed any flexibility.

Kashif Ali Malik, further maintained that the petitioner created third party interest without adhering to the CDA by-laws.

On July 1, the CDA had sealed the under-construction-multi-storey hotel for various building and layout plan violations.
