The Islamabad High Court (IHC) on Tuesday stopped the authorities from merging the Capital Development Authority’s (CDA) employees in the Islamabad Metropolitan Corporation (IMC) without getting their consent.

A bench comprising Justice Aamir Farooq passed this direction while hearing the petition moved by the CDA Employees Union against their merger in IMC.

During the course of proceedings, the counsel for petitioner alleged that the management transferred the CDA workers to IMC and later on, without getting their consent merged them in the same department.

According to the Local Government Act, no employee could be merged to another department without their consent and merging of the CDA employees is a violation of rules, the counsel added.

He said the CDA employees are not ready to surrender themselves to the IMC and requested the court to intervene into the matter.

After going through the arguments, the court directed the authorities to get consent of the employees following the Local Government Act before their merger in the IMC.

The Capital Administration and Development Division (CADD) secretary, CDA and mayor of the capital territory and federation were made respondents in the petition.
