SC rejects plea for staying bidding on contract for construction of Dasu dam

The Supreme Court (SC) has turned down a petition filed by the Power China Construction Company seeking a stay order against the bidding process for awarding contract for the construction of Dasu dam.

A two member bench of the SC led by Chief Justice (CJ) Anwar Zaheer Jamali took up the case for hearing Monday.

Suleman Aslam Butt, counsel for the petitioner, prayed to the court to stay the bidding for awarding contract for the construction of Dasu dam which was to take place on Monday.

The counsel for the Water and Power Development Authority (WAPDA) told the court that the bidding for the contract was opened at 11 AM.

The CJ remarked “The World Bank is providing funds for the project. Can we go against conditions set by the World Bank?”

Justice Sheikh Azmat Saeed remarked “Who will provide the funds if the World Bank suspends funding due to interference of the court? A foreign company says agreement between the government and the World Bank be revoked. If we accept the plea of the foreign company, then everything will stand undone.”

The court while directing the petitioner to provide copy of the decision of the high court rejected the petition seeking the stay order.
