The decision on whether Nelson Agholor will go to trial for an alleged sexual assault now resides with Philadelphia District Attorney Seth Williams, Philadelphia magazine reported.

The 23-year-old Eagles wide receiver is accused of raping a dancer at Cheerleaders Gentlemen’s Club, a claim Agholor denies.

“We’ve been in touch with the investigators, but I can’t comment on the progress of the investigation,” Agholor’s attorney, Fortunato “Fred” Perri said. “It’s always difficult when something like this happens. (Agholor) has been staying close with his family and doing the best he possibly can.”

The 27-year-old dancer made the allegations after Agholor and two other Eagles, Fletcher Cox and Connor Barwin, visited the club June 9. Police reviewed video surveillance, which didn’t reveal any signs of an assault.

There have been reported claims that Agholor had a private dance with the woman, but instead of paying her a promised $1,400, she was paid $800.
