The Sindh High Court (SHC) on Monday allowed a private superstore in Gulshan-e-Iqbal to reopen, setting aside the administration’s closure order.
Chief Justice Sajjad Ali Shah headed a divisional bench that heard the plea challenging administration’s order to keep the store closed from 3pm till 9pm over traffic issue as there is no parking space there.
During the hearing, the court asked the administration’s representatives to explain why the business should be closed over a traffic issue. The representatives could not satisfy the bench.
The court directed the administration to control traffic and if it does not, it is its failure. “If people park their vehicles outside the newly inaugurated store despite administration’s warning, it is its failure,” the court stated.
The court allowed the administration to impose a fine ranging up to Rs 10,000 and lift the car of the violator.
The store was allowed to reopen while the police was directed to control the traffic and take an action against any violation.
Earlier, the store was closed by the administration after the traffic halted several times due to no parking space available, jamming other roads.
