SHC suspends operation of letters against Bahria Town Clifton project

The Sindh High Court (SHC) on Wednesday suspended the operation of letters which had cancelled the allotment and part plan of Bahria Town Clifton project.

The SHC bench, headed by Justice Nadeem Akhter, also issued notices to Karachi Metropolitan Corporation, Sindh Building Control Association (SBCA), Land Department of Karachi Development Authority (KDA) and deputy director of Master Plan Department directing them to file their comments on the next hearing.

M/S Bahria Town (Pvt) Limited approached the court against the cancellation of allotment and withdrawal of part plan of Bahria Town apartments project in Block No 3, Scheme No 5, Clifton.

The petitioner submitted that the Master Plan Department deputy director on 4th of December 2015 withdrew the part plan and after that its allotment was cancelled by the KDA’s land department on 22nd of December 2015. The M/S Bahria Town (Pvt) Limited requested the SHC to declare both the letters as void and unlawful. The court suspended the operation of both the letters till 6th of May 2016 and directed the respondents and advocate general to file the comments on the next hearing. It was submitted in the letter issued by the Master Plan Department on 4th of December that the NAB was investigating regarding actual area covered by allotted land. According to the letter, the NAB had questioned whether total area of projects land was 2,200 or 5,148 sq yards.
