SC gives CDA deadline to remove road blocks, encroachments

The Supreme Court (SC) gave the CDA until March 3 to remove road blocks and encroachments besides stopping commercial activities from the residential areas of the city.

The court on Thursday ordered that CDA should implement its rules, take action in this respect and present a report before the court.

The court also refused to give more timeframe to IG Islamabad and IG Motorways for vacating their offices and rejected their petitions in this respect.

Justice Sheikh Azmat Saeed remarked “if the government could not implement a law then it should suspend it. The government should tell that the law is not applicable”.

He further remarked that under the law “we should endorse illegal work of the federal government”. The judge said that the Additional Attorney General (AAG) has failed to file a report with regard to the steps taken to remove encroachments.

He observed “don’t blackmail the court. We have no powers to give time. This is a court and not an office of a real estate. We are making it clear that if government did not to implement the law then we will get it implemented”.

He remarked “listen that no compromise will be made on the law and constitution. The federation should give reply in writing that it has to implement the law or otherwise we will issue orders.”

The AAG told the court that 80 per cent of the IG office building has been vacated and time was needed for shifting offices of both the IGs.  AAG once again requested the court to give time. We will shift offices. There are problems, he said.

Justice Saeed remarked “problems are only due to the reason that you don’t implement the law. If law had been implemented then situation would not have been like this today”.

The court while adjourning the case till March 3 sought replies from the federal government and CDA in writing. Reply has also been sought from IG Islamabad and IG Motorways.
