PHC holds KP IG in contempt for ignoring court’s order

A divisional bench of Peshawar High Court on Monday issued contempt of court notice to Inspector General Khyber Pakhtunkhwa and sought reply from him for not complying with court orders.

Hearing a contempt of court petition filed by Afrsaiab and other through their attorney Saadullah Khan, the bench comprising of Justice Waqar Ahmad Seth and Justice Musarrat Hilali was informed that a month ago court had ordered the police department to recruit assistant sub-inspector and not through Public Service Commission.

He argued that PSC has the authority to make recruitment from grade-11 and above and the commission has no authority to make recruitment of ASI.

He argued that despite court’s clear order recruitment were being done on the posts through PSC in violation of court orders.

The bench after hearing the arguments issued order to IG KP Nasir Durrani and ordered him to file a reply to non-compliance of court orders.

The same bench in another case ordered the police department to allow candidates who had applied for inspector and sub-inspectors posts to let them appear in written examination.

The bench also sought reply from chairman PSC on the petition filed by Imran Khan and others. The bench while hearing advocates Akbar Khalil and Amirzeb Mughal was informed that the department had advertised around 326 vacancies for inspectors and sub inspectors to be made by PSC.

They argued that the petitioner along with other had passed physical test after which PSC conducted another test called ‘Ability Test’ which was not mentioned in the advertisement.

They argued that PSC failed maximum of candidates and adopted that the test was illegal that aimed to recruit blue-eyed candidates. He prayed to allow the petitioners appear in the written test which was accepted by the bench and ordered to allow petitioners appear.
