Punishments given by military court cannot be pardoned: SC

The Supreme Court of Pakistan has ordered Sheikhupura jail officials and the JAG branch to go ahead with legal proceedings as per the law in the reconciliation case of Lance Naik Mukarran Hussain, who was convicted by a military court.

A three-judge bench of apex court headed by Justice Amir Hani Muslim conducted the hearing of the case. During the hearing, the head of the three-judge bench Justice Amir Hani Muslim observed that the culprit was convicted by a military court, and asked how he could be pardoned by a civilian court.

Justice Khilji Arif Hussain observed that JAG should explain whether a pardon could be given based on reconciliation or not.

The father of the accused informed the apex court during the hearing the family had informed the military unit about the reconciliation. Based on that information the military unit had written a letter to the Sheikhupura jail authorities. He also presented a copy of the letter to the court.

The court summoned a reply on the issue by March 2.
