LHC issues notice to Kanju, others on appeal against acquittal

A Lahore High Court division bench Wednesday issued notices to Mustafa Kanju and others on an appeal against their acquittal in Zain murder case.

The division bench headed by Justice Syed Mazahar Ali Akbar Naqvi issued notices on an appeal filed by the provincial prosecution department.

During the hearing, Prosecutor General Punjab Ehtesham Qadir arguing before the court submitted that the trial court acquitted the accused after retraction of some witnesses. He submitted that the trial court failed to record statements of the investigation officer, recovery officer and other officials which was mandatory.

Additional Prosecutor General Abdul Samad also submitted that a DNA report had revealed that the blood stains found on shirt of Mustafa Kanju’s security guard, Asif ur Rehman, had matched. He said that the trial court ignored the circumstantial evidence and acquitted Kanju and his guards without fulfilling legal requirements. At this, the bench issuing notices to Mustafa Kanju and others and sought their replies.
