IHC terms appointment of MD PTDC against rules

The Islamabad High Court on Wednesday announced judgment while terming the appointment of Chuadhry Kabeer Ahmed, Managing Director Pakistan Tourism Development Corporation (PTDC) void.

A single Judge bench of Justice Noorul Haq N Qureshi issued the judgment comprising seven pages and directed authorities to appoint a new MD, while following the Public Procurement Regulatory Authority (PPRA) rules and regulations.

Earlier Chaudhry Tanveer Akhtar, former joint secretary (IHCB) and petitioner alleged before the bench that Chaudhry Kabir Ahmed had no experience regarding tourism as he was earlier deputed in Revenue Department.

He further alleged that no advertisement was published prior for the said post and ultimately through a notification of the Cabinet Division without getting will of the Board of Directors of PTDC authorities appointed Chuadhry Kabeer Ahmed on April 2014.

He said that the appointment was the violation of memorandum of article 112 of PTDC adding that codal formalities were not followed. He requested the court to set aside the appointment of the MD PTDC or any remedy in this regard.

Justice Noorul Haq N Qureshi directed Abdur Rehman and Raj Saim ul Haq Satti counsels for PTDC to submit all minutes of the meetings of Board of Directors, advertisement for the post, criteria, or any concerned document to brush away the allegations.

But no such document was submitted to the court in compliance with the court orders.

After going through the comments submitted by the respondents in this regard the bench reserved judgment to announce later.
