Court reserves verdict on maintainability of appeal against Kanju’s acquittal

 

The Lahore High Court on Tuesday reserved its verdict on the maintainability of an appeal against the acquittal of Mustafa Kanju and others in the Zain murder case.

The bench headed by Justice Shahid Hameed Dar heard the appeal filed by the provincial prosecution department.

During the hearing, Punjab Prosecutor General Ehtesham Qadir submitted that the trial court had failed to observe the provisions of law properly, adding that it was bound to check whether the witnesses were speaking the truth, but it failed to consider the fact.

He said that the witnesses had retracted from their earlier statements before the trial court. He further argued that the forensic report had proved that Zain had been killed by a bullet fired from the Kalanshnikov recovered from the accused. The prosecutor requested the court to set aside the verdict of the trial court.

The bench, after hearing detailed arguments, reserved its verdict on the maintainability of the appeal.
