A division bench of Lahore High Court Wednesday acquitted Qari Muhammad Yousaf, an activist of banned Sipah-e-Sahaba, involved in distribution of hate material.
The bench headed by Justice Shahid Hameed Dar acquitted the accused while accepting his appeal against five-year jail term by the trial court.
During the hearing, the appellant’s counsel arguing before the court submitted that Okara police registered a fake case against the convict and it failed to present a single independent witness and solid evidence against him during the trial.
But despite the fact, the trial court failed to appreciate case circumstances and awarded five years jail term to the convict, he added. He pleaded the court to acquit the convict after setting aside the verdict.
However, the prosecution opposed the request and submitted that the convict was an activist of banned Sipah-e-Sahaba and he was caught red handed while distributing the hate material.
To which, the appellant’s counsel submitted that the material recovered by the police was not presented before the trial court.
The bench after hearing detailed arguments of parties acquitted the convict while setting aside his sentence.
