SHC notices SBCA, others on petition against construction project

The Sindh High Court (SHC) on Friday issued notices to the Sindh Control Building Authority (SBCA) and Al-Ghafoor Residency & Mall’s owner to file comments on the petition seeking stay order for the construction project in Gulshan-e-Iqbal.

The SHC bench headed by Justice Irfan Saadat was hearing the petition filed by Rana Faizul Hasan, the secretary general of Human Rights Commission of Pakistan, who sought stay order for Al-Ghafoor Residency & Mall project in Gulshan-e-Iqbal as it was violating SBCA rules and regulations.

The petitioner stated that Al-Ghafoor Residency & Mall was being constructed against the approved plan. According to public notice issued by the SBCA on 15th August 2012, the project’s approved plan consists of basement (shops & air raid shelter), ground floor (shops), 1st floor (parking), second floors to 8th Upper Floors (flats), 9th & 10th floor (Duplexes) only.

According to the petitioner, the builder is making 11th floor and constructed more shops than the approved plan. He stated that the owner of the project overlooked the safety measures like fire extinguishing system.

Citing the SBCA, Al-Ghafoor Residency & Mall owner, and Adminstrator Karachi as respondents, the petitioner requested the court not to allow the builder to construct the project against laws. He requested the court to restrain the relevant authorities from providing utility facilities to the project and sub-leasing until the court’s order. After initial hearing, the court issued notices to the additional attorney general, SBCA, and administrator Karachi to file comments on 7th October 2015.
