The Sindh High Court (SHC) on Tuesday stayed the construction of “Zam Zam Homes” project in Parsi Colony, Jamshed Town, Karachi.
The SHC stayed the construction of the project for constructing more floors against the approved plan and using it for commercial purpose. The SBCA had issued construction permission on a plot having number 64-JM Jamshed Quarter, Jamshed Town Karachi, to one Jabir Sadiq on 27th November 2014. According to a public notice issued by the SBCA, the project was approved for basements/parking+ ground (recreational area & flat), 1st to 4th floor.
The petitioner, Rana Faizul Hasan, Secretary General of NGO Human Rights Commission of Pakistan, named the Sindh Building Control Association (SBCA), Director MPGO, owner of ZAM ZAM Homes project, K-Electric, MD KWSB, MD SSGC, Sub-Registrar Jamshed town and Administrator Karachi as respondents.
The petitioner pleaded the court that owner of “Zam Zam Homes” project was constructing against the plan approved by the SBCA. He submitted that the project’s owner had got B+G+4 approved plan from the SBCA to construct residential flats but now he was constructing more floors. “Zam Zam homes” project is now being constructed for commercial purpose which is violation of the Supreme Court’s order, he alleged.
In the petition, Hasan requested the court to ask the SBCA how residential plot can be used for commercial purpose. He requested the court to restrain KWSB, SSGC and K-electric to provide utility facilities to the project until the court’s order.
