Meanwhile, a two-member bench of the Supreme Court (SC) on Tuesday stayed execution of a death row prisoner, Allah Ditta, who was scheduled to be hanged in Kot Lakhpat Jail on August 5.
The bench directed Punjab prosecutor general to assist whether a convict could be released after being pardoned by heirs’ of victim under Anti-Terrorism Act, or the court can intervene in the matter.
The court also ordered to communicate its orders to the jail authorities concerned immediately.
The bench comprising Justice Mian Saqib Nisar and Justice Ijaz Ahmad Chaudhry passed the orders on an appeal filed by Shahzad Ahmad, son of Allah Ditta, while hearing the matter at Supreme Court Lahore Registry.
Earlier, the petitioner’s counsel arguing before the court submitted that heirs’ of victim had pardoned the convict but despite that the court concerned issued his black warrants for August 5. He contended that the step was illegal as the convict could not be hanged after being pardoned by the heirs.
