Federation moves IHC for stay in bureaucrats’ promotions’ case

The federal government on Monday filed a petition in the Islamabad High Court (IHC) seeking stay order to stop implementation of its verdict against the promotion of civil servants of BPS-20 to BPS-21 till the expiration of time allowed for an appeal.

A single-judge bench of Justice Aamir Farooq heard the plea filed by the Federation through Additional Attorney General (AAG) Afnan Karim Kundi for the suspension of the implementation of a short order of July 27 passed by Justice Shaukat Aziz Siddiqui, declaring promotions void.

The AAG took the stance before the bench that being aggrieved party the federation intends to file an appeal in the Supreme Court against the order.

He said as reasons of the short order are still awaited and only the detailed judgement would enable applicant to adequately formulate the questions of law for the determination by the Supreme Court.

He said that without detailed reasoning of the order, applicants could not effectively assail the short order or assist the apex court. He further took the plea that “order had been passed in the petition concerned promotion of civil servants from BPS-21 to BPS-22 and were not recommended by the Cental Selection Board (CSB) for promotion rather by High Powered Selection Board (HPSB). The short order is only about the proceedings of CSB that recommends promotions of civil servants to BPS-20 and BPS-21.”

The applicant prayed for stay order requesting that if it was not granted then it would affect the promotions process substantially as the short order had inter alia, set aside the discretionary 15 marks vested in the CSB.

The bench after hearing the arguments issued notices to respondents and adjourned the hearing of the case till August 7.
