The Sindh High Court on Monday allowed an independent candidate to contest the by-elections on the National Assembly constituency (NA-246).
A two-judge bench allowed an appeal filed by Ashraf Ali Qureshi against Sindh Election Commission of Pakistan’s decision that rejected his nomination papers.
Nominating returning officer for NA-246 and Super Market police station’s SHO as respondent, the appellant submitted that his nomination papers were rejected on the sole ground that that his proposer, Naeem Ahmed Kayani, was not on the electoral list for the constituency.
Counsel for the appellant argued that the ECP had issued certificate to his proposer, certifying that he was on the electoral rolls, despite the fact his papers were rejected on that ground.
Terming the decision illegal and unconstitutional, he pleaded to the court to overturn the decision and allow him to contest the polls.
