SHC issues notice to KMC head on petition against encroachment

The Sindh High Court Wednesday issued notice to the Karachi Metropolitan Corporation’s (KMC) administrator, land management director, and other official respondents to file comments on a petition seeking removal of encroachment from a commercial plot in North Karachi.

A division bench, headed by Justice Hassan Azhar Rizvi, had taken up a petition filed by a businessman who moved the court against the civic authorities and North Karachi Industrial Area’s SHO for failing to remove encroachment from the plot.

The petitioner’s counsel Usman Tufail Sheikh submitted that his client had purchased a commercial plot St-1/1, Block 12/D at North Karachi admeasuring 2288.9 square yards at the public auction.

He said the petitioner had paid all the charges but could not get possession of the plot as it was encroached upon. The counsel said his client had complained to the authorities concerned to remove encroachment from the plot but to no avail. The petitioner apprehended that the concerned authorities might cancel lease of the plot illegally on the ground that it was not utilised yet, therefore, he requested the court direct the authorities to remove encroachment from the plot and restrain them from cancelling the lease.

After initial hearing, the bench issued notice to the respondents with direction to file comments on the petition till April 02. The court restrained the authorities from taking adverse action in respect of the subject plot.
