The Sindh High Court has sought comments from the federal government, Pakistan Bar Council, Sindh Bar Council and the National Testing Service (NTS) chairman on a petition against NTS examination for grant of practicing licence to lawyers.
A division bench, headed by Justice Sajjad Ali Shah, also issued a notice to federal and provincial law officers to file response to the petition. The petitioner, Sara Rasheed, an LLB degree-holder, submitted that the government through an amendment in Pakistan Legal Practitioners and Bar Council Rules 1976 made NTS examination mandatory for apprentice advocates for acquiring practicing licence.
She submitted she had applied for the licence and submitted required documents and fee. The NTS examination was scheduled to be conducted on January 18 but later it transpired to her that Lahore High Court had granted stay order against the test.
The petitioner said she was totally oblivious of the current status of stay order as the Sindh Bar Council was not providing details about it nor it was accepting their intimation for starting of the training. She requested the court to declare that the NTS test as contrary to Section 26 of the Act and direct the bar to accept his intimation for the training.
