The Supreme Court (SC) has sought reply from National Accountability Bureau (NAB) within 48 hours for not filing reference against the people found responsible in railway scrap stealing case.
While presiding over a three-member SC bench during the course of case hearing Monday, Justice Mian Saqib Nisar remarked, “The freedom of the citizens cannot be compromised as per Constitution. NAB holds others accountable. Why should we not hold it accountable? No one will be allowed to curb liberties of citizens. It is binding on NAB as per law and constitution to initiate proceedings.”
Khalid Farooq, counsel for the petitioner, appeared in court and told that no action has been taken against any culprit. No reference has been filed since December, 2013.
“Had reference been filed it would have been decided so far. NAB has taken action against only two or three persons including his client contractor Jawwad and no action has been initiated against the remaining persons,” he said.
While expressing resentment over the situation, Justice Nisar remarked, “NAB officials should fear from God. Why are they not launching proceedings against the remaining accused? Why is the investigation being delayed? How can the NAB curb freedom of citizens?”
He ordered NAB investigation officer to file reference against the remaining accused. “Nothing will happen only by taking action against the low-cadre persons. Action should have been taken against other responsible persons. Reference has not been evolved in this respect.”
The court sought reply from NAB besides adjourning the hearing of the case till February 18.
