The Islamabad High Court (IHC) has summoned Islamabad Police Inspector General (IG) Tahir Alam Khan on February, 9 in contempt of court case against Islamabad Secretariat Police station house officer (SHO) for not registering murder case of two people killed in a drone attack in the area of  Mir Ali at South Waziristan in 2009.

As the case came up for hearing before IHC Monday, Mirza Shahzad Akbar, counsel for petitioner Karim Khan, Assistant Sub-Inspector (ASI) Nawaz Bhatti from Secretariat Police Station and legal counsel Abdul Rauf appeared in the court.

Justice Shaukat Aziz Siddiqui asked Bhatti as to why he had not registered a murder case of people killed in drone strike so far as per high court’s orders when the Secretariat Police SHO had admitted in court that murder case of those killed in drone strike can be registered.

Bhatti told court that the Islamabad commissioner had written a letter to FATA Secretariat in drone attack case as per court’s orders, saying that murder case of two people killed in drone stroke be registered.

FATA Secretariat said in reply that operation was in progress in South Waziristan area therefore, no proceedings could be initiated in this case and the case could be registered when the situation normalizes.

“Murder case can be registered anywhere. People sitting in Islamabad are operating everything from here. The police should not fear registering case as there will be no drone attack on your police station,” Justice Siddiqui said.

“You people should act upon the law of the country. You people should not need fear from any one. The law of the land is clear and action should be taken as per this law. This should not be said that situation is not normal. This is the matter of a Pakistani citizen. He can get a murder case registered wherever he wills. There is no limit of one district or other district,” he further observed.

The case hearing was adjourned till February, 9.
