Islamabad High Court (IHC) has reserved judgment in bail before arrest plot transfer case in respect of Capital Development Authority (CDA) employee Zafar Mehmood Raja.
Justice Noorul Haq N Qureshi while expressing displeasure over police investigation officer remarked, “Is it the job of police to provide protection to the accused? Which law has allowed you that you neither present challan of the person who is named in FIR nor he is arrested? Why the court should not order for registering cases against the investigation officers? Islamabad’s situation has deteriorated and police system is also not correct.”
A single bench of IHC comprising Justice Noorul Haq N Qureshi took up for hearing bail before arrest plea from CDA employee Zafar Mehmood Raja.
Barrister Jahangir Jadoon appeared on behalf of federation while Naveed Malik represented the rival party.
The court was told that CDA had allotted a plot along with Engro farm in 2004 but the accused Raja Zafar Mehmood sold out this plot to another party through fraud and its occupation was also handed over.
The counsel for the petitioner told the court that Raja Zafar Mehmood and Nasir Saeed who are CDA employees transfer the plot to the people fraudulently and then sell them out to others.
The court was told this person got allotted a plot in 2004 and later sold it out to a new party in 2012. The petitioner approached police against the accused. The police arrested Raja Zafar Mehmood and other people, recovered the arms and registered the case.
Justice Qureshi inquired from investigation office what investigations he has made against the accused.
Investigation officer told case file had been provided to him a day before and earlier it was held by some other investigation officer.
The hearing of the case was adjourned indefinitely.
