NA adopts 21st Constitutional Amendment, Army Act Amendment

The 21st Constitutional Amendment Bill and Pakistan Army (Amendment) Bill was approved by the National Assembly on Tuesday, private media reported.

2457 NA members voted in favour of the bill while  MNAs from Jamaat-e-Islami (JI) and Jamiat Ulema-e-Islam-Fazl (JUI-F) abstained from voting

The NA session resumed today to discuss and vote on the 21st Constitutional Amendment Bill and Pakistan Army (Amendment) Bill tabled in the Parliament on Saturday  to provide constitutional cover to the military-led speedy trial courts (STCs) in terrorism-related cases.

Thebill is now expected to be passed by the upper house and signed into law by the president this week.

It will stay on the books for two years, allowing military courts to try anyone accused of terrorism offences.

The federal government on Monday deferred until Tuesday (today) voting on the two government bills aimed at setting up constitutionally protected military courts to try civilian terrorism suspects.

Members of the National Assembly arrived in parliament on Monday to vote on the two bills – the Constitution (Twenty-first Amendment) Bill and the Pakistan Army (Amendment). But voting was deferred after the government fell short of the required two-thirds majority – 228 members – for the passage of the constitutional amendments after Jamiat Ulema-e-Islam-Fazl (JUI-F) chief Fazlur Rehman expressed reservations on the bill, saying his party would not vote in favour of the amendment in its current form.

Fazl also staged a walkout from the session but was later talked into returning to the House by Finance Minister Ishaq Dar and Information Minister Pervaiz Rashid. However he remained stuck to his guns on not endorsing the amendment bill, which he said was aimed at targeting the religious seminaries.

Following approval of the bills in the National Assembly, the bills will be tabled in Senate.

The draft of constitutional amendment which was unanimously laid out by the political leaders in All Parties’ Conference.On January 2nd, the All Parties Conference (APC) chaired by the PM had reached a consensus to bring amendments in the constitution as well as the Army Act for the establishment of special courts. The meeting was attended by the country’s top civilian and military leadership.

Following 16 December’s deadly Taliban attack on Army Public School in Peshawar, civil and military authorities have amped up their anti-terror strategy. A day after the attack , Prime Minister Nawaz Sharif lifted a six-year moratorium on the death penalty, reinstating it for terrorism-related cases. Since then, seven convicts have been executed.

  1. Too little. Too late. This is not the solution to pakistans overwhelming terror threat. This is only a small step – where as we need huge leaps. Give them their sharia state. Divide nwfp and ket these killers murder each other.

  2. UK divided ireland because it became cancerous – we need to do same. Theres no winning with these people. Best we can do is partition. UK became stronger once ireland was seperated and so will we.

  4. Pak Army Courts means Civil/Criminal courts of Pakistan not delivering justice.
    It is need of era to strict the laws, facilitate the Courts.
    the person who is involve in terrorism, waging of war of insurrection against Pakistan or threatening the security of Pakistan by the terror, is not required to be tried in Pak Army Courts, it is the need of era that such like persons are to be finished. there is no need for trial, the need is to be finished. hence, no need of Army Courts. There is need to strengthen Pakistan civil and criminal courts. Commencing trial against such persons amounts to give them a way.

  5. it is failure of judiciary. the judges(not honor able) not working but getting privileges from the taxes of poor Pakistani nation. They are employed to provide justice but failed . they are not putting resignation..shame…The military officer are not for this job. The judges should be given military training and be sent on borders to defend the homeland or be sent to school to serve as teacher. An other amendment be tabled to provide justice in civil and criminal cases. and a time frame be given to the judges for disposal of the cases.Thank Pakistan defense forces no thanks to the judges.

Establishment of Military Courts and their Constitutional Protection is in simple words is failure of judiciary and civilian security agencies, but it right decision in current situation …we should appreciate it that Govt realized the its own and judiciary's incapability of Judiciary to tackle with current situation ….
