Islamabad High Court (IHC) has suspended show cause notice issued by PEMRA acting chairman to general manager (GM), assistant GM and other officers in respect of their induction and relaxation of age granted to them in connection with their appointments.
The court has issued notice to acting chairman PEMRA and sought written reply from him.
Justice Noor ul Haq N Qureshi took up for hearing PEMRA GM Haji Adam, Assistant GM Hafiz Junaid and other senior officers case Monday.
Shoaib Shaheen counsel for the petitioners appeared in the court and told that the petitioners are senior officers of PEMRA. They were appointed in PEMRA by previous government. Acting chairman PEMRA Pervez Rathore issued show cause notice to them on December, 16, 2014 which has been challenged in the court. All such acts being practiced by acting chairman PEMRA are but acts of political victimization. Baseless and illegal cases have been instituted against all these employees.
He told the court that PEMRA has issued show cause notices to them on the basis of relaxation in age, experience and their appointments and case is pending hearing against them in the court. Acting chairman PEMRA can not take action against these officers being their cases pending hearing in the courts nor can he issue any show cause notice to them.
He further said that acting chairman is not entitled to take any action against regular officers as per constitution. Acting chairman has neither nominated any inquiry officer against these officers nor has given any reasons for not holding inquiry against them and action is being taken only on political considerations.
The court while suspending show cause notice sent by acting chairman PEMRA to GM, Assistant GM and other officers of PEMRA on December 16, 2014 has issued notice to acting chairman PEMRA and other parties and sought reply from them.
The hearing of the case was adjourned indefinitely.
