IHC releases alleged Mumbai attacks mastermind Lakhvi

India conveys ‘strong concern’ over Lakhvi’s release, calls for speedy trail of Mumbai attacks accused; Pak high commissioner says trial a ‘purely judicial matter’

The Islamabad High Court (IHC) Monday temporarily suspended the detention orders of Zakiur Rehman Lakhvi — the alleged mastermind of Mumbai attacks — on the condition that the accused submits a security bond worth Rs 1 million and ensures his presence in every hearing of the case.

The court issued a two-page judgement on Lakhvi’s release and decided to take up the matter after January 7, 2015.

IHC’s Justice Noorul Haq Qureshi presided over the hearing of a petition filed by Lakhvi, seeking an end to his detention.

Lakhvi was granted post-arrest bail by an anti-terrorism court (ATC) in Islamabad on December 18. However, the federal government had extended his detention in the Adiala Jail under the Maintenance of Public Order ordinance.

On December 26, Lakhvi had challenged his detention in the IHC.

During Monday’s hearing, Jahangir Khan Jadoon – the standing counsel representing the government – asked the court not to suspend the detention order and requested for more time as the IHC had issued notice to the federation and sought its reply today.

During the hearing, Lakhvi’s counsel Rizwan Abbasi said that the court had previously accepted his client’s bail but the administration that had detained him by flouting court orders and hence the detention was illegal. He added that the granting of bail was an issue of fundamental rights.

After hearing the counsel’s arguments, the court suspended Lakhvi’s detention.

According to an official of the Islamabad Capital Territory (ICT), the basic objective of the detention orders issued earlier, after the attack of Army Public School (APS) Peshawar was to prevent Lakhvi from attending any public meeting and potentially regrouping in its aftermath.

Sources in the ICT administration further said that the capital’s authorities also requested the Punjab Home Department to issue orders for Lakhvi’s detention to prevent him from moving to his hometown Okara.

Lakhvi was detained in Adiala Jail alongside six other suspects charged with planning and helping carry out the 2008 Mumbai attacks. The six other men are Hammad Amin Sadiq, Shahid Jamil Riaz, Younas Anjum, Jamil Ahmed, Mazhar Iqbal and Abdul Majid.

At the time of the attacks, Lakhvi was believed to be the operational head of the banned Laskhar-e-Taiba (LeT) that has been accused by India of carrying out the attacks in Mumbai.

Lakhvi along with Zarar Shah was allegedly the key planner of the attack that killed 166 people.

INDIA CONCERNED OVER LAKHVI’S RELEASE:

Following the suspension of Lakhvi’s detention orders, Indian Ministry of External Affairs (MEA) summoned Pakistan’s High Commissioner to India Abdul Basit in New Delhi and the Indian mission in Islamabad also took up the matter with the Pakistan Foreign Office.

“Basit was summoned to the Indian MEA by Foreign Secretary Sujatha Singh on Monday. Singh conveyed strong concern at the lack of effective action by Pakistan’s prosecuting authorities after the ATC ordered Lakhvi’s release,” said Indian MEA official spokesman Syed Akbaruddin.

“It was once again conveyed that we expect the Government of Pakistan to abide by the commitment conveyed to us, including at the highest level, that expeditious steps would be taken to bring all those responsible for the acts of terrorism in Mumbai to justice,” he said, adding that it was extremely disturbing that despite the assurances India has been receiving over the past six years, and the recent tragedies in Pakistan, “there seems to be no end in sight to Pakistan remaining a haven for well-known terror groups”.

Diplomatic sources confirmed that Basit was summoned. Basit reportedly assured the Indian Foreign Ministry that the trial of those accused of carrying out the Mumbai attacks, including Lakhvi, was purely a judicial matter and that it was in progress.

  1. Pakistan is feeding and nurturing snakes so it can send those snakes to other countries to kill people of other countries. But you know what, those snakes will bite and kill your own people one day. And that is happening already. Pakistan will never prosper as a nation until it stops nurturing terrorism. You have no money to feed your own people but you are able to fund terrorist organizations? You beg for money after a flood but you can spend money in war? Pakistan ministers have brain washed and misguided the common people of Pakistan. If you have something called brain then look at unbiased history of India. Long back Muslims entered India to invade India. They did loot the country. They killed people in India. They raped women. They converted people to Islam. Still India accepted Muslims as brothers. During national movement of India, extremely greedy Jinnah wanted to be prime minister. Nehru too wanted to become prime minister. So, they divided the country to become prime ministers. India should never have given any piece of land to Muslims because Muslims entered India with sole purpose of invading India. But, India still gave land to Muslims to form their own country called Pakistan. India decided to forget the past Muslim terrorism. India has a big heart. But those greedy ministers in Pakistan were still not happy. They wanted more. So, they kept attacking India again and again. India even today allow Pakistani singers and actors to go to India and prosper there. Because, India has big heart. But looking at history, it seems back stabbing is in the blood of Pakistani leaders. When all other countries are working on development, Pakistan nurtures terrorists.

      • India needs RAW because of Pakistan's terrorist organization ISI and other Pakistan funded terrorist organizations. If Pakistan stops terrorism, RAW will not be needed as much.

        If you go to your neighbor's house to capture and loot their properties and then you torture the family members, kill them, rape them, convert them to Islam, do you expect the surviving members of that family to accept you as brother? NO. But India just decided to forget past attack on them by Muslims.

        Yes, India accepted Muslims as brothers, that is why India gave them land to form Pakistan. India accepted Muslims as brothers, that is why India has much more Muslims than the total population of Pakistan. India accepted Muslims as brothers, that is why India allows Muslims to prosper in India.

        Do you know A. P. J. Abdul Kalam? He is the former president of India and a scientist.
        Do you know Salman Khan, Sharukh Khan, Aamir Khan, Amjad Khan, Kader Khan? They all prospered in Indian film Industry.
        Do you know Zakir Hussain, Amjad Ali Khan, Salim–Sulaiman? They are top Indian musicians.

        They are all Indian Muslims and the list is very big. There are millions of Muslims who prospered in India and that happened because India didn't discriminate against Muslims or people of any religion.

        Can you tell me how many non-Muslim people could prosper in Pakistan? How many non-Muslim ministers do you have? How many non-Muslim musicians do you have? How many non-Muslim scientists do you have?

        You can't find many non-Muslim people who prospered in Pakistan. Because Pakistani leaders discriminate against religion and they don't allow any non-Muslim person to prosper in Pakistan.

        If you talk about Gujarat and Kashmir incidents, you need to know bad politicians exist in every country. And bad politicians make people fight. It has nothing to do with any particular religion. Gujarat and Kashmir incidents don't indicate India is against Muslims in anyway.

        Just think how much money India has to waste every year to counter Pakistan's terrorism. That huge amount could be used for much more development.

        Pakistan begs money from various countries and uses that money to fund terrorism.

        Pakistan can prosper like other countries if they work on development rather than creating and nurturing terrorists.

  3. Mkg, what are India consulates doing at Af-Pak border? India has admitted to causing trouble in Balochistan and financing banned outfits. India has caused trouble in the whole region, including Sri Lanka etc. Eddied, those 6000 terrorists are convicted but were not executed. We're executing them now.

    My only reply would be the type of hate that Indian has shown many times to Pakistan and it's citizens is not hidden from world. Time and again, India has broken many promises and RAW has done a lot of damage through Afghanistan now which also had its footprints in Baluchistan. But ISI will take care of RAW that we have firm belief on.

    Muslims have been so used to be on top of everything that you being indian could simply not stop letting them go on top among you as they are well capable people no matter where they live.

    All personnel examples you have given are all good examples to classify such muslims being in India and on top and others visiting india from Pakistan to keep Indian economy and industry strong.

    Rest assured every nation has bad/good politicians and people and you can simply not put blame openly to any nation.
