The Islamabad High Court (IHC) Tuesday fixed a petition challenging the appointment of advocate general in Islamabad Capital Territory (ICT) for hearing on December 3 (today).
A single bench of the high court would take up the petition filled by Muhammad Ashiq Bhatti for hearing.
The petitioner has questioned if the Constitution allows the appointment of advocate general in ICT. He further took plea that the appointment of AG is provincial subject and not of federal. He asked if the appointment could be made in ICT prior to a constitutional amendment.
Bhatti took the ground that according to Article-140 of the Constitution only the governor of a province shall appoint the AG and no other authority could appoint AG. He prayed the court that the appointment of AG ICT may set-aside keeping in view the Article-140 of the Constitution.
