Subordinate court cannot interfere in SC matters: IHC

During the course of hearing of petition filed against annual election of Supreme Court Bar Association (SCBA) for the year 2014-15, Justice Athar Minullah of Islamabad High Court (IHC) said that subordinate court could not interfere in the matters of Supreme Court.

Chaudhry Ikram counsel for the petitioner, additional attorney general (AAG) and counsel for Pakistan Bar Council (PBC) appeared in the court.

The counsel for the petitioner told the court that official counting of SCBA elections for the year 2014-15 were not conducted nor was result of the election provided to the petitioner.

Justice Minullah remarked, “Court and bar should be respected. Therefore, it is better that a committee comprising senior lawyers upon whom both the sides have no objection be constituted to resolve this matter.”

The counsel for the petitioner agreeing with the court said that he had no objection over it that court constitutes committee of senior lawyers which holds recounting of SCBA elections.

The court issued directives to counsel for president SCBA and counsels for Pakistan Bar Council that they should inform it in this regard after consultation with president SCBA. Court does not want that any decision is given with reference to SCBA election which causes distaste.

The court adjourned the hearing of the case for one day.
