The Sindh High Court (SHC) on Friday once again directed the superintendent Karachi Central Prison to submit a report on whether two inmates, who were repatriated from Afghanistan after serving 12 years in the prison, were detained under any unlawful orders.
A two-judge bench also directed the respondents – Sindh chief secretary, home secretary, and DIG prison to file their respective replies to the petition.
The petitioner, Fazal Karim, moved the court seeking recovery of his brother Saifullah and cousin Fazal Karim said to be illegally detained by law enforcers under the MPO.
The petitioner submitted that his brother and cousin had gone to Afghanistan to inquire after the health of their aunt. There they were assaulted by American forces when they were taking ailing aunt to the hospital.
The petitioner stated that their aunt died on the way to the hospital while they were taken into custody by the American troops. He added that they were detained in the prison for 12 years and after their release they were repatriated to Pakistan.
He said his brother and cousin were arrested under the MPO by police on their arrival and they were transported to Karachi Central Prison. He said since they were not involved in any criminal activity, they were detained by the law enforcers illegally. He pleaded to the court to direct jail authorities to release them.
