Court says no to petition seeking to halt NA-122 record inspection

The Lahore High Court (LHC) on Thursday dismissed the petition submitted by National Assembly Speaker Sardar Ayaz Saddiq counsel to halt election tribunal’s proceedings regarding record inspection in NA-122 constituency.

The LHC single bench comprising Justice Ijazul Hassan declared the petition as non-maintainable.

The petition was seeking cancellation of the proceedings of the election tribunal hearing Imran Khan’s election petition against election of Ayaz Sadiq from the National Assembly constituency NA-122.

The speaker in his petition pleaded that rival candidate Khan didn’t fulfill the legal requirements and had requested cancellation of the proceedings of the election tribunal. The counsel of Khan argued that the High Court could not issue orders over the proceedings of election tribunal.

The bench declared the petition non-maintainable and stated that in the light of a decision of the full bench of the court, the High Court could not hear cases against decision of an election tribunal and advised the petitioner to take the matter to the Election Commission.

The LHC in its verdict said that the high court cannot interfere in the matters of election tribunal.
