The Supreme Court (SC) Tuesday sought details from the government within 24 hours in respect of appointments of heads of institutions made via Competition Commission against vacant posts.
A three-member SC bench headed by Chief Justice of Pakistan (CJP) Nasirul Mulk took up for hearing Ghulam Rasool versus Federation case.
The CJP enquired from the attorney general about the number of institutions to which heads were appointed through the commission and how many of the heads could not be appointed.
The AG said that heads of some of the institutions had been appointed and sought time to inform the court about the details.
Justice Amir Hani Muslim enquired, “Tell us how the Competition Commission (CC) was constituted, who are included as members of this commission and on whose orders was the CC formed.”
The AG replied that the federal tax ombudsman, Shams Lakha and Dr Ejaz Nabi are members of the commission. This commission was constituted in the light of the SC orders in the Khawaja Asif case and its notification was issued by the Establishment Division, said the AG.
Citing Article 240 A and Article 242, the AG said that the criterion of appointment is different in both the articles.
“Article 240 has set a necessary procedure for appointment by the authorities whereas under Article 242, appointments are made through Federal Public Service Commission (FPSC),” he said.
Adjourning the hearing of the case till Wednesday the court sought details from AG about appointment of heads to key institutions.
