IHC upholds suspension of Section 144 imposition

Islamabad High Court (IHC) Friday upheld suspension of the notification regarding imposition of Section 144 in the Federal Capital and ordered Additional Attorney General Afnan Karim Kundi to present the list of terrorists detained so far.

IHC’s Judge Justice Athar Minallah heard the case pertaining to imposition of Section 144.

During case proceedings, the judge asked whether the government intends to impose Section 144 on Eidul Azha or any other occasion.

Pakistan Tehreek-e-Insaf (PTI)’s counsel told the court that if such an action was taken, it will be difficult to offer Eid prayers.

Additional Attorney General Kundi stated that there were threats due to the ongoing military operation, Zarb-e-Azb, in North Waziristan Agency and several terror incidents had already taken place in different areas.

“The measures are being taken to avert any untoward incident in Islamabad,” he said.

The additional attorney general argued that the government had issued No Objection Certificate (NOC) to the protesting parties – PTI and Pakistan Awami Tehreek (PAT), adding that both the political parties later violated it.

Meanwhile, the court upheld the decision regarding suspension of Section 144 imposition notification and directed the additional AG to present a list of those terrorists who have been detained so far.

The hearing of the case was adjourned till October 13.
