IHC orders petitioner to file PHC, IHC decisions in drone attack cases against Musharraf
Islamabad High Court (IHC) has directed the petitioner to attach all the record of decisions given by Peshawar High Court (PHC) and IHC in drone attack cases with the petition filed by him for registration of murder case against former president Pervez Musharraf in respect of people killed in drone strikes.
A single bench of IHC comprising Justice Shaukat Aziz Siddiqui took up for hearing the constitutional petition filed against Musharraf Thursday.
In the hearing of the petition filed by a citizen through his counsel Mian Ahmad Khan, Deputy Attorney General (DAG) Hasnain Akbar Kazmi and Mian Ahmad Khan advocate counsel for petitioner appeared in the court.
Counsel for petitioner argued that Musharraf had reached a written agreement with US authorities allowing US to conduct drone strikes in tribal areas of Pakistan. Several innocent citizens have been martyred in these drone attacks from 2004 to 2013 in tribal areas of the country, therefore, court should order for registration of murder case against Musharraf in respect of the innocent citizens killed.
Justice Siddiqui asked the federation’s counsel to not fear when he requested the court to give him more time in the case. He directed the petitioner that PHC and IHC had given decisions in drone strike cases, therefore, all the record pertaining to these verdicts be attached with his petition.
Additional Sessions Judge West, Islamabad Police SSP and Secretariat Police Station SHO have been made respondents.
