The Sindh High Court (SHC) on Tuesday directed the home secretary to submit a joint investigation team (JIT) report on alleged illegal detention of a dental surgeon by the law enforcement agencies (LEAs).
A division bench headed by Justice Ahmed Ali M Shaikh gave this direction while hearing a petition filed by Munira seeking recovery of her spouse Dr Ismail Sheikh allegedly arrested by LEAs personnel.
She submitted that her husband left home for hospital on April 18 but did not return and since then he was missing. She alleged that personnel of LEAs, including spy agencies, have arrested her husband. The petitioner said that LEAs personnel raided her house in Gulistan-e-Johar and took away a laptop, two cell phones and personal documents of her husband.
She said that LEAs personnel also kept her husband in illegal detention despite the fact there was no criminal case pending against him. The court was requested to direct LEAs officials to produce him before it. Hearing of the case was adjourned till August 26.
Meanwhile, the same bench while hearing another petition sought the JIT report from law enforcers on illegal detention of a missing man by LEAs personnel.
The petitioner, Alam Munir, moved the court seeking recovery of his brother Mehboob Munir. The petitioner submitted that his brother Mehboob was picked up from Jacob Lines area on January 2014 by personnel of law enforcement agencies and since then he was missing.
He told the judges that law enforcers had kept his brother in illegal detention and did not produce him in any court of law if he was involved in any case. He said he approached the higher officials of LEAs seeking recovery of his brother but his plea fell on deaf years.
The court was requested to order LEAs to recover the detainee and produce him in the court.
