The Sindh High Court (SHC) on Thursday suspended the notification for suspension of the Sindh accountant general.
The petition was heard by a 2-member bench comprising Justice Muneeb Akhtar and Justice Shafi Siddiqui. The petition was filed by AG Muhammad Ashraf Shaikh through advocate Ali Asad Billo.
The counsel said his client was transferred on Jul 16, 2014, on the directives of Prime Minister Nawaz Sharif and the controller general of accounts did not have any authority to pass orders for transfer of officers in grade 21. The auditor general of Pakistan had the powers to pass such orders, he added.
After hearing the arguments, the bench ordered for immediate restoration of the AG Sindh on his post and discharged the petition.
In another case, the same bench also restored Abdul Raheem Khatri, a Karachi Water and Sewerage Board Chief Engineer. The bench suspended orders of Khatri’s suspension by Sindh Minister for Local Government Sharjeel Innam Memon.
In the previous hearing the bench had issued notices to the minister, secretary local government, secretary finance and M/s Muhammad Ayub and Company to submit their explanations on Thursday but the minister declined to submit any explanation. Therefore, the higher court had once again ordered respondents to submit their explanation on bogus tendering in favour of M/s Muhammad Ayub and Company on Aug 11, 2014.
It is worth mentioning that the petitioner Khatri had opposed the award of tender to the said firm worth Rs 1.2 billion upon which he was punished and suspended.
