No one is bound to resign till finalisation of irregularities case: ECP

No person is bound to quit his National Assembly constituency during hearing of electoral rigging petitions filed against him, said an Election Commission of Pakistan (ECP) official on Wednesday.

Commenting on Pakistan Tehreek-e-Insaf (PTI) Imran Khan’s demand that NA Speaker Ayaz Sadiq should resign during the proceedings regarding rigging in his constituency, the ECP official said, “There is no law to back up Khan’s demand that Sadiq should resign from the NA till petitions against him are decided.”

The ECP official added that in case anyone quits his NA seat, the ECP is bound to hold by-polls in that constituency within 60 days.

Responding to a question, he said that local and international observers had termed General Elections 2103 as fair and transparent.

The ECP official said that the irregularities committed by Khan’s counsel and adjournments taken by him during hearings of the petitions regarding rigging in NA-122 have exposed the PTI leadership’s claims regarding poll rigging.

He said that there are several irregularities in the petition filed by Khan, including submission of a female’s affidavit for a male polling station and non-provision of original affidavits.

ONLY TRIBUNALS CAN VERIFY VOTES:

He said that as per the law and Constitution, the PTI chief’s demands for verification and recounting of votes in some constituencies could only be taken up by Election Tribunals.

“ECP will implement the decisions taken by ETs without delay,” he said.

He said that according to the law, ECP could, within sixty days of the elections, order recounting and even re-election in any constituency where it was convinced of prima facie irregularities. After the lapse of this period all such matters have to be dealt with by ETs, he said.

The official said that anyone having any objection against the chief election commissioner (CEC) would have had to approach Supreme Judicial Council for the CEC’s removal as per Article 209 of the constitution.
