Sindh High Court (SHC) on Monday issued notice to Education & Literacy Department special secretary and Schools Education director for defying its order that reinstated the district education officer (DEO) Syeda Nelofer Ali in her post.
Headed by Justice Munib Akhtar, a division bench of SHC was seized with hearing of contempt of court application filed by DEO, who cited Education & Literacy Department Special Secretary Syed Zakir Ali Shah and Education Director Schools Abdul Wahab Abbasi as contemnor.
Malik Altaf Javed, counsel for applicant, submitted that she was illegally removed from the post on July 8 by director education schools on charges of mismanagement, indiscipline and involvement in malpractices.
He said that no transfer order had been issued by competent authority, adding that Abdul Wahab Abbasi issued transfer order which, according to him, besides being illegal and unconstitutional, was serious abuse of the power by him, as he was not the competent authority to take action against her.
Counsel for applicant said that the court had granted stay order against her removal from the post, adding that on previous hearing, Shah appeared before the bench in pursuance of the court notice and told the judges that transfer order of petitioner was withdrawn.
During hearing on Monday, the applicants counsel stated that though, the provincial authorities had submitted copy of order to division bench regarding her reinstatement yet she was not being allowed to resume her duty. He requested the court to initiate contempt of court proceedings against contemnors for disobeying the court order.
After hearing arguments on application, the two-judge bench issued notice to contemnors, asking them to be in attendance before the court on July 28. It warned them if they failed to show up, coercive action shall be taken against them.
